Terms of Use

The following Terms of Use apply to the relationship between e-Marketers and the users of e-Marketers.
Function
E-Marketer is an Internet marketplace for the distribution market. The portal offers manufacturers, sales representatives, sales partners and field representatives the opportunity to easily publish their sales offers and applications and to get in direct contact with each other. E-Marketer acts neither as an intermediary, nor as a consultant. All contacts are made exclusively between advertisers and users.

Providing
E-marketer makes his offer without any obligation to maintain the operation available. E-Marketer reserves the right to make subsequent changes or cuts to the insertion without the prior consent of the advertiser and to delete advertisements without consultation. The advertiser has no legal claim to publication of his advertisements. By posting advertisements, the user grants e-marketers a free, unlimited and irrevocable, worldwide, non-exclusive, sub-licensable right to distribute, duplicate or otherwise use the content.

Use
Only one active account per user / company is allowed. With the use of E-Marketer, advertisers and users automatically receive an irregularly appearing newsletter informing about current advertisements and news. The newsletter can be unsubscribed at any time via the link listed therein.

Contact Advertiser
Contact for advertising purposes or on the basis of general placement offers and advertising is not permitted. Likewise, no contacts are allowed who are being picked up for fraud or fraudulent purposes or who violate applicable law.

Contact / information
The advertiser undertakes to provide a valid address in the EU and to have his seat in one of these countries. Furthermore, he undertakes to provide valid data for the objects he has registered. The user assures that all information provided by him is true.

Content
Each advertiser is responsible and liable for his advertisements and their contents. Listings with
- political, religious, insulting, defamatory,
- harassing or offensive content,
- infringing content,
- Advertising,
- Company Presentation / Advertising,
- Multiple advertisements for the same purpose (also in modified form and different categories),
- Order requests,
- Product sales / requests,
- Intermediation Offers / Business Contact,
- Structure Sales / MLM,
and offers outside the EU
are not allowed. Likewise, no advertisements are permitted that are published for fraud or fraudulent purposes or that violate applicable law.

News
Personal messages and inboxes are stored in the mailbox for up to four weeks, after which an automatic deletion is provided by the system. The user has no legal right to the storage or delivery of his messages.

Self-Government
All advertisements and data are to be managed by the advertisers via the account itself, in particular with regard to creation, modification and deletion of entries. The user has no legal right to create, edit or delete his entries by the operator.

Editorial intervention
If a manual intervention by the editors is required or necessary because of a disregard of these conditions of use, this will be charged according to the current rates of the executing service provider. The current rates can be requested in advance from e-marketer.

Failure
Violations or disregard of the terms of use will result in the permanent exclusion of the advertiser. Advertisements with inadmissible content or incorrect information will be removed without comment. The Advertiser further agrees to cover the costs of the expenses incurred by removing invalid entries or removing entries with false information.

Liability
The operators are responsible according to the general laws only for their own content. As a service provider, operators are not required to monitor the information transmitted or stored by them or to investigate circumstances that indicate unlawful activity. Obligations to remove or block the use of information under general law remain unaffected. A liability in this regard is only possible from the time of the knowledge of a concrete infringement. Upon notification of such violations, this content will be removed immediately.

Indemnity
By using e-Marketer, you agree to indemnify and hold harmless e-marketers and the owners, agents, co-owners of trademarks or other business associates and employees with respect to any claims or claims made by third parties arising out of or in connection with you Any content that he or she enters, publishes or transmits as part of the Services, or is collected through his or her use of the Services, its connection to the Services or violations of these Terms of Use or any third party rights. This also applies to reasonable legal fees. E-marketer is not liable for possible damages resulting from the advertisements. A liability for material and legal defects of the advertisements, in particular for their correctness, freedom from errors, freedom from protection and copyright of third parties, completeness and / or usability as well as for lost contacts or business is expressly excluded. If we provide information or have software available for download, we will not be liable for any resulting damage, e.g. by misinformation or computer viruses.

Distancing
The operators of e-marketers concretely and expressly dissociate themselves from all contents of the advertisements as well as contents of the pages to which reference is made from this server.

Involvement
In case of competition, domain law, copyright or similar issues, please contact us. We will remove the content immediately and provide all legally permissible information about the cause. The cost note of a lawyer's warning without prior contact with e-marketer is rejected in the sense of mitigation obligation as unfounded.

Severability clause
If any provision of these Terms of Use is ineffective, the remaining provisions remain unaffected. The ineffective provision shall be deemed replaced by a provision that comes closest to the meaning and purpose of the invalid provision in a legally effective manner.
